The contained within Terms of use ("Terms") are applied to any and/or all image(s) and/or image kits owned by Heavens Kiss Design and/or Ariel Cooper.
Purchase and Availability of Image(s) and/or Kit(s)
I. All Image(s) and/or kit(s) will be available to you for 2 weeks (14 days) from date purchased.
a. After initial receipt of images, please contact Ariel Cooper or Heavens Kiss Design at the email address below or the contact link on the main page. After which time, images will no longer be provided unless repurchased. Therefore we recommend that you back up your order once received on the media of your choice;
b. After 14 days, but prior to 120 days (four months) you may repurchase image(s) and/or image kit(s) for ½ price. After 120 days, the kit will be full price.

II. All included images are Copyrighted by Ariel Cooper and Heavens Kiss Design and therefore protected. All rights reserved.

Usage of Image(s) and/or Kit(s)

III. These images are for personal use under the conditions listed herein. If you would like to use them for commercial use, please contact Ariel Cooper or Heavens Kiss Design at the email address below or the contact link on the main page.

IV. Image(s) and/or Kit(s) purchased MAY NOT be re-distributed in any way or for any reason.

V. No image may be used for commercial purposes (if commercial use is desired, please contact Ariel Cooper or Heavens Kiss Design at the email address below or using the contact link on the main page).

VI. If an image is used, please give credit to Ariel Cooper and/or Heavens Kiss Design [i.e. "Image created by Ariel Cooper and Heavens Kiss Design].

VII. PERMITTED USES:

1. You may:
a. Use and incorporate the Content in your personal scrapbooking layouts, blogs, facebook, twitter, myspace and other social media, as well as personal non-commercial websites;
b. Print image(s) for offline use for scrapbooking, creating personalized non-commercial items such as mugs, shirts, hats, funeral, wedding birth announcements and programs, etc. (Churchs may use images in their programs as well);
c. Alter image(s) by changing the size, color, adding to or deleting from image(s);
d. Use image(s) and/or kit(s) in your created image(s) that are submitted to websites, magazines, newspapers, ezines, and/or other digital/printed publication as long as credit is given to Ariel Cooper and/or Heavens Kiss Design and a link is provided to the store where you purchased the product (please see store listing below) and/
e. Make one (1) copy of the image(s) and/or kit(s) solely for back-up purposes (you must reproduce all notices (including Terms) on the back-up copy;

VIII. PROHIBITED USES:
1. You MAY NOT:
a. Use the image(s) and/or kit(s) for any purpose that is not expressly permitted in paragraph VII above;
b. Provide a copy of ANY image(s) and/or kit(s), or any portions thereof, to anyone or grant access to anyone to ANY image(s) and/or kit(s), or any portion thereof, except as permitted above;
c. RESELL or REDISTRIBUTE any image(s) and/or kit(s) as clipart, digital or hard content, templates or on any site or in any store;
d. Use the image(s) and/or kit(s) in design template applications for resale, including, without limitation, website templates, flash templates, and brochure design templates;
e. Display the image(s) and/or kit(s) on ANY websites used for or in commercial use and/or intended to create, generate or produce sales;
f. Claim image(s) and/or kit(s) or altered image(s) as your own;
g. Alter any and all image(s) and/or kit(s) and then claim them your own.
h. Take any part of image(s) and/or kit(s), incorporate it into another image then claim it as your own;
i. Use image(s) and/or kit(s) or portion thereof, as a trade-mark, logo or other business and/or business like use(if you desire this, contact Ariel Cooper and/or Heavens Kiss Design at email address below or contact link on main page);
j. Use image(s) and/or kit(s) in any manner in which results in a re-distribution of image(s) and/or kit(s);
k. Use image(s) and/or kit(s) in any way that is, to an average American citizen, considered defamatory, promotes racism, bullying, discriminatory, terrorism, libelous, criminal activity or illegal in any way;
l. Use any image(s) and/or kit(s) in any manner which depicts a person to endorse a business, product or service;
m. Remove any notice of copyright, trade-mark or other proprietary right from any place where it appears on or in the image(s) and/or kit(s) or its accompanying materials;
n. Store a copy of image(s) and/or kit(s) on a network server or web server (except a personal home network/server) for use by other users;
o. Transfer the rights to image(s) and/or kit(s) or accompanying materials (if applicable), except as specifically provided for elsewhere in this Agreement;
p. Provide the editable pieces of the kit to anyone else under any circumstances;
q. Use image(s) and/or kit(s) in the creation of Desk Tops, blog backgrounds or any other item that is intended to be sold or given to the general public as a "freebie" on a blog or any other website. You may make these items for your personal use, however, you may not share them without first obtaining my permission.
